I do not support The Copyright Royalty Board's (CRB) March 2nd decision to substantially increase royalty rates. Not only will it impact my choices, but the Recording Industry Association of America's (RIAA) manipulation of these rates, and the CRB's indifference will hurt working artists, damage small record labels and force law abiding small webcasters, already paying a large portion of their revenue per month in royalties, out of business. This decision will also damage hundreds of small businesses providing goods and services to working artists, small record labels and small webcasters.

I respectfully ask that you evaluate the CRB decision and do whatever is necessary to establish a reasonable royalty rate for all the parties involved.
Who, What and When

On March 2, 2007, The CRB approved royalty rates that will bury any small webcaster, and create a heavy burden even for big broadcasters like Yahoo, AOL Music and Pandora. How high will these rates be? Around 100% of a small webcasters revenue, give or take a few points, in most cases. What?! That's impossible to pay! Yep, it sure is..

How did this happen? The RIAA told the CRB thats what they wanted, and the CRB just gave it to them.

Your're probably thinking, hey that's awful, but who are the the RIAA and CRB?

RIAA (Recording Industry Association of America) is a lobbying group formed by the five largest record labels. They are embedded in Washington D.C. They make sure laws are written to keep them rich, no matter what. They made headlines a few years ago opening lawsuits against elderly people, single mothers and children for trading music online, even though some of them didn't even have computers. Check out the latest RIAA headlines.

The CRB (Copyright Royalty Board) is part of the US Copyright Office. The Board is charged with determining the royalty rates that would be determined by a willing buyer and a willing seller in a marketplace transaction. They decided to jack the rates beyond a broadcasters means despite decades of royalty rates being 1 - 2% of broadcaster revenue. Raise your right hand if you want to take away consumer choice, hurt working artists, damage small record labels and put small webcasters out of business.

To give credit where credit is overdue, I should mention that MOST of the pictures that I use to punctuate stories and articles I submit here, come from Wonderful Russ!

Russ doggedly and obsessively accumulates unusual articles, jokes and photos all over the Internet and relays them on, to a private mailing list - to which I subscribe. Sure it costs a lot but the occasional porno is worth it. The naughty pictures and jokes often brighten up my day. It would yours, too.

Russ will tell you "Business in the Real Estate industry is great!" But that's only true if you are selling cemetary plots or are part of an invading army in the middle east. Russ has a lot of time on his hands - and probably some other stuff, judging from the sexy pics.

At any rate you and all the other folks at the nursing home/dating service, deserve a good chuckle and/or tittilation (rhymes with "nation") each day. Prices vary according to your age, gender and ability to pay but it's usually far below the amount of your church tithe. Sure, it won't get you IN to Heaven but it will get you THERE. Then, you are on your own.

But a ruling from an obscure, 3-person panel from the Library of Congress threatens the existence of Pandora, and every other internet radio service out there. The plan from the Copyright Royalty Board is to increase the fees to internet radio operators so high that they will effectively be out of business. Paying $.0008 a song might not sound much, but if you consider the millions of songs per day served up by Pandora alone, it becomes a very large bill indeed.

Here is a hero in the making - at least in my book. She is carrying the banner for what I have been preaching, for years. We are poisoning our kids to make them SUBMIT. Submit to money that is progressively worthless. Submit to weak cowards who govern our lives from secret societies. Who just dont like cigarette smoke (so no one can smoke), who create insane rules of living so we will submit to insane rules.

Hell - by these standards Dr. Timothy Leary WAS INSANE! He's the one who said; "Think for yourself, question authority.. " That of course is the most anti-social statement ever made. Except perhaps these, by Jane Fendelman.

THIS is how we get heros. Somebody stands up and objects to being made to SUBMIT.

As a counselor, over the last five or six years, I have been seeing an alarming trend...an epidemic...of grammar-school aged children (6, 7 and 8 years old) coming in deeply lonely and feeling "not good enough", with their self-esteem destroyed, Collapsing Syndrome (the inability to tolerate the slightest frustration) anxiety attacks, stunted growth, sleeping and eating disorders, ticks (from the meds), mood swings and Suicidal Ideation. As a teacher, counselor, mother and student, I know homework should not be given before 6th grade and I know children shouldn't be drugged.

All day, every day, I have parents coming into my office asking me how get their kids to do homework. The families miss eachother terribly. All they ever talk about is school, grades and homework. There is no family "love-time." Everyone is on the hamster wheel.

In Avondale, AZ we had a 4th grade girl commit suicide last month. A few weeks ago in Boston, a four and a half year old little girl died from a lethal combination of meds for ADHD and Bipolar "Disorders". We have 160 ADD/ADHD med-related deaths reported in the US and similar reports from the UK.

How many more children do we have to kill?

There were 31 million prescriptions written for ADHD in the last year alone.
There is NOTHING wrong with your child! It is simply unrealistic and unfair to expect a child under the age of ten to be capable of spending an entire day in school and then come home and sit down to do homework at night.

It is a lose/lose situation. The children feel like a failure because they can't get through their homework after a whole day in school. The parents feel like a failure because they can't make the kids do their homework. Families are missing out on their "love time" because parents have to be the slave-driver every night.

NO MORE HOMEWORK BEFORE 6TH GRADE AND NO MORE DRUGGING OF CHILDREN AND MAKING THEM THINK THEY ARE DAMAGED GOODS!!!

RIAA to Universities: You'd Better Help Us Threaten Your Students...

The RIAA is at it again, it ain't enough to take away internet radio, they're swingin' from all sides! Here's the latest from those who 'represent' recording artists (any guess what part of the royalties in question will go to artists??)

**RIAA OFFERS SWEET DEAL TO UNIVERSITIES: HELP US THREATEN YOUR STUDENTS! WE'RE DOING THEM A FAVOR!!
Not content with wasting universities' resources via their usual tactics (i.e. flooding schools with machine-generated complaints about file sharing) the major record labels are now DEMANDING that universities help them shake down students.

**HEY KIDS! THIS IS AMERICA! LET'S MAKE A DEAL!
The RIAA wants universities and colleges to forward "pre-lawsuit" letters to alleged file sharers promising a "discounted" settlement price if the student agrees to PAY UP immediately.

**SAVE US MONEY FOR YOUR SAKE!
This saves the RIAA the trouble and expense of filing a lawsuit to obtain students' contact information, a savings they may be redirected to MORE lawsuits.

**DON'T WORRY! WE'LL TELL YOU ALL THE FACTS!!
To add insult to injury, the letters advise students to contact the RIAA if theyhave any questions. It's safe to say that the RIAA is unlikely to give students the full picture. For example:
1. Will the RIAA tell students that parents are generally NOT liable for infringements committed by their kids?
2. Or that the record labels sometimes sue the wrong people? (WHAT?!SAY IT ISN'T SO!)

**UNIVERSITY OF WISCONSIN: YOU'RE NOT JUST CHEESY, YOU'RE DELICIOUS!! WHY?
The University of Wisconsin is REFUSING to forward the pre-litigation letters to its students. Brian Rust of the Univ of Wisconsin's IT department said: "These settlement letters are an attempt to short circuit the legal process (in order) to rely on universities to be their legal agent." HEY, UNIVERSITY OF WISCONSIN, GIVE THAT GUY A RAISE!

Joe Boyd, Producer

Hi-

It may be too late for some of you in different time zones, but at least in Arizona Joe Boyd will be a guest on NPR's "Fresh Air" program TODAY (3/20/07) at 2:00 (or at least sometime in the 2-4:00 time frame). Joe Boyd is the man who produced classic albums by Fairport Convention, Richard and Linda Thompson, Sandy Denny, Nick Drake, The Incredible String Band, and other luminaries of the British folk-rock scene in the late 60s/early 70s. He also played an important role in early Pink Floyd (the Syd Barrett era) and later on he produced REM's "Fables of the Reconstruction." He has a new book out called "White Bicycle" (the title comes from a Syd Barrett song) about his days with the above-mentioned artists and others. LISTEN if you can, and if you can't, try to find the interview in the NPR on-line archives some other day.

Latest vintage airchecks

From Tom Wright: the latest discovered airchecks (see earlier post from Tom, reprinted below), including one from the last day of the Sixties (12-31-69) with Ron Wortham. Also a 1963 broadcast revealing KCAC’s earlier incarnation, and a 12-31-69 KRIZ broadcast.

Thanks to collector Gary Pfeifer, I now have a brief tape (on CD) of Ron Wortham on the air at KCAC on New Years Eve 1969! It's short but sweet, most of the music is edited out (just fragments of Creedence and Led Zep), but there's about 8 minutes worth of talk and commercials. Ron mentions how cold it was that morning at his "house in the country" (Starbrite) and that his car was iced over and "Bill's car broke down." There are also commercials for Wallich's Music City and for a New Years Eve show that night with Waylon Jennings at JD's.

On the same disc is - get this - a brief recording of KCAC in 1963, when it was an R&B station! Only about 6 minutes long but it contains a mix of DJ chatter, commercials (including one for an upcoming show by James Brown), and music (one complete song by Jimmy Reed). The date is November 21, 1963, the day before a somewhat more ominous event.

The disc also contains a non-KCAC aircheck, again from December 31 1969, of Phoenix Top-40 station KRIZ. This aircheck runs 32 minutes and the DJ is Mark James. It seems to be intact and unedited - i.e., music, commercials, everything that aired during that 32 minutes. Music ranges from Zeppelin to "Gimme Shelter" to whatever else was in the Top 40 at that time.

Quality of the tapes is variable (and mostly pretty hissy) but they are all perfectly listenable. Don't ask me who recorded them, or why, or anything else - this information doesn't tend to travel much in the community of aircheck aficionados, where the recording itself is the object of interest, and it passes through many hands and much copying along the way. The important thing is that the tape has been added to the growing KCAC archives!!!

Advice to Young Men from an Old Man

1. Don’t pick on the weak. It’s immoral. Don’t antagonize the strong without cause, its stupid.
2. Don’t hate women. It’s a waste of time
3. Invest in yourself. Material things come to those that have self actualized.
4. Get in a fistfight, even if you are going to lose.
5. As a former Marine, take it from me. Don’t join the military, unless you want to risk getting your balls blown off to secure other people’s economic or political interests.
6. If something has a direct benefit to an individual or a class of people, and a theoretical, abstract, or amorphous benefit to everybody else, realize that the proponent’s intentions are to benefit the former, not the latter, no matter what bullshit they try to feed you.
7. Don’t be a Republican. They are self-dealing crooks with no sense of honor or patriotism to their fellow citizens. If you must be a Republican, don’t be a “conservative.” They are whining, bitching, complaining, simple-minded self-righteous idiots who think they’re perpetual victims. Listen to talk radio for a while, you’ll see what I mean.
8. Don’t take proffered advice without a critical analysis. 90% of all advice is intended to benefit the proponent, not the recipient. Actually, the number is probably closer to 97%, but I don’t want to come off as cynical.
9. You’ll spend your entire life listening to people tell you how much you owe them. You don’t owe the vast majority of people shit.
10. Don’t undermine your fellow young men. Mentor the young men that come after you. Society recognizes that you have the potential to be the most power force in society. It scares them. Society does not find young men sympathetic. They are afraid of you, both individually and collectively. Law enforcement’s primary purpose is to suppress you.
11. As a young man, you’re on your own. Society divides and conquers. Unlike women who have advocates looking out for them (NOW, Women’s Study Departments, government, non-profit organizations, political advocacy groups) almost no one is looking out for you.
12. Young men provide the genius and muscle by which our society thrives. Look at the Silicone Valley. By in large, it was not old men or women that created the revolution we live. Realize that society steals your contributions, secures it with our intellectual property laws, and then takes credit and the rewards where none is due.
13. Know that few people have your best interests at heart. Your mother does. Your father probably does (if he stuck around). Your siblings are on your side. Everybody else worries about themselves.
14. Don’t be afraid to tell people to “Fuck off” when need be. It is an important skill to acquire. As they say, speak your piece, even if your voice shakes.
15. Acquire empathy, good interpersonal skills, and confidence. Learn to read body language and non-verbal communication. Don’t just concentrate on your vocational or technical skills, or you’ll find your wife fucking somebody else.
16. Keep fit.
17. Don’t speak ill of your wife/girlfriend. Back her up against the world, even if she’s wrong. She should know that you have her back. When she needs your help, give it. She should know that you’ll take her part.
18. Don’t cheat on your wife/girlfriend. If you must cheat, don’t humiliate her. Don’t risk having your transgressions come back to her or her friends. Don’t do it where you live. Don’t do it with people in your social circle. Don’t shit in your own back yard.
19. If your girlfriend doesn’t make you feel good about yourself and bring joy to your life, fire her. That’s what girlfriends are for.
20. Don’t bother with “emotional affairs.” They are just a vehicle for women to flirt and have someone make them feel good about themselves. That’s the part of a relationship they want. For you it is a lot of work and investment in time. If they are having an emotional affair with you, they’re probably fucking someone else.
21. Becoming a woman’s friend and confidant is not going to get you into an intimate relationship. If you haven’t gotten the girl within a reasonably short period of time, chances are you won’t ever get her. She’ll end up confiding to you about the sexual adventures she’s having with someone else.
22. Have and nurture friendships with women.
23. Realize that love is a numbers game. Guys fall in love easily. You’re going to see some girl and feel like you’ll die if you don’t get her. If she rejects you, move on to the next one. It’s her loss.
24. Don’t be an internet troll. Got out and live life. There is not a cadre of beautiful women advertising on Craigslist to have NSA sex with you. Beautiful women don’t need to advertise. The websites that advertise with attractive women’s photos and claims of loneliness are baloney. All they want is your money and your personal information so that they can market to you. The posts on Craigslist by young “women” seeking NSA sex, and asking for a picture are just a bunch of gay troll pic collectors. This is especially true if the post uses common gay lexicon like [[[LIMITED TO GUYS ONLY]] (ed.) or seeks “masculine” men, or uses the word cock (except in the context of “Don’t send a cock shot.”) There are women on Craigslist. They are easily recognizable by their 2-5 paragraph postings. Most are in their 30's or older.
25. When you become a man in full, know that people will get in your way. People who are attracted to you will somehow manage to step in your path. Gay guys will give you “the look.” Old people will somehow stumble in front of you at the worst time. Don’t get frustrated. Just step aside and go about your business. Know that these are passive aggressive methods to get you to acknowledge their existence.
26. Don’t gay bash. Don’t mentally or physically abuse people because of who they are, or how they present themselves. It’s none of your business to try to intimidate people into conformity.
27. If your gay, admit it to yourself, your parents, your friends and society at large. Be prepared to get harassed. See rule 14. If someone threatens you or assaults you, call the cops. Have them arrested. You have no obligation to self sacrifice because of who you are. As a gay person, you’ll have more social freedom than straight men. Use it to protect yourself. Be prepared to get out of Dodge if your orientation makes your life unbearable. Move to San Francisco, New York, Atlanta, or New Orleans. You’ll find a welcoming community there.

TIME WAS you could take your guitar, go sit on a curb and sing a song to passers-by who might drop some change in your guitar case. Enough for coffee maybe or a sandwich - but that wasn't the point. The point was THE PERFORMANCE, the ART of creating entertainment to be shared between a voluntary performer and a voluntary audience, a way of making love with strangers.

My, how things have changed. If you do that these days, it had better be YOUR song or you owe money to ASCAP, BMI and now the RIAA (which used do be a fraternity of audio technicians in the 1960's) - in pre-determined amounts according to the size of your audience and how long you play. And if you sing YOUR OWN song, get ready to license it or have it stolen.

THIS IS WHY IT IS SO DAMNED TOUGH for internet radio stations to survive. Radio Free Phoenix is a perfect example. WHY do they need donations? Bottom-feeders. Scavengers like RIAA who somehow have found a lawyer or two (whores) to attach themselves as parasites to anything creaive in our society.

THIS article [click the headline] I believe, is completely unfair and is perhaps a grand example of reverse-spin applied by liberal media to Our President..... yours and mine.

The VERACITY of the statement MUST be brought forth for public debate - the credibility of the office of President and all that implies on the International front - is at stake in this situation.

This topic will inevitably need to be defined LEGALLY because only the legal system has the resources to handle the definition properly. This carries over into the realms of Clinton's "Definition of 'is' " - as he so eloquently conveyed it during the impeachment/Lewinsky broo-ha.

IS the First Lady a C*nt as described by The President? Or is she NOT a C*nt? Does the "Definition of 'is' " rule apply HERE or is this another situation awaiting sustaining evidence e.g. the Lewinsky dress. If not, then "is" is actually "NOT is" and then we must all QUESTION the Presidential (mis-use) of C*NT when it should have been CU*T or even CUN* - but certainly not *UNT wherein the accusasion would have lost all definition. Inevitably it would seem, this matter must prioritize itself to the final attention of The Supreme Court.

Then too (and as a word of caution to all who might engage in this legal debate) - there are certain levels of disagreement with Our President that Homeland Security has and will, come to regard as treasonous. Therefore as long as The President is saying it and for as long as we as a nation are obliged to respect the point of view of our Commander In Chief, we as citizens would best take up the chant and carry forth The Banner.

Whatever you say, Mr. President.

Richard Thompson shows & more

Hey everyone-

Richard Thompson played three solo/acoustic shows in Arizona last week, two of which I attended - Flagstaff on March 7th and Phoenix on March 8th. Both shows were awesome displays of guitar prowess, great songwriting, and powerful singing. I used to hear Fairport Convention on KCAC/KDKB; who knew that their shy lead guitarist would go on to such heights? See him when he comes to your town (or anywhere within 200 miles of your town), buy his CDs, shower him with money and praise. He deserves it.

The Tempe facility I mentioned as a possible "June reunion" site is a bust, so it will have to be somewhere else. The Alwun House would be perfect if it's available. As for the Crawford Cache of KCAC tapes: I've had two cost estimates for professional restoration and digitizing, and I'm talking with various folks (on and off the blog) about funding ideas. Be patient; it will be worth the wait, and I hope we can get it done sooner rather than later.

First things first..... Dan Kana (The Electrician) Covington is coming in for his mom's birthday in April. He will be in Tucson and Phoenix in I believe, mid-month. Good reason for a party!

I've e-mailed Mariah a couple months ago that we'd be open in the most glorious temperate dates from April, or May for such a gathering (having had so many "May Day" festivals in our shaded gardens - May 1 is also when there's Immigrant and recent resident parade in Phoenix (remember 500,000 at last years march?)

Is this the same time of Kona Dan Covington's visit?

Mariah -

For the reunion: what about indoors at the Alwun House, with patio access - best of both worlds? Or some other indoor/outdoor facility with a clubhouse-style interior but also a shaded patio, lots of tables and chairs, maybe access to a swimming pool? Larger public parks may have such places available, for a fee (Encanto Park, maybe?). The Desert Botanical Garden has a lovely place, perfect for parties, but it's probably pretty expensive (and it may already be booked up months in advance). There's also the Elias-Rodriquez House here in Tempe, a nice facility (no swimming pool, though) in an old 1880s house just off the ASU campus, owned by the City and rented out for special occasions. I could check on price, amenities, and scheduling. Any other ideas out there? Yeah, in theory we could put this off till it's cooler, but then it becomes too easy to keep putting it off until it never happens. Let's set a date and DO IT!

Thank you for coming tonight - the reason I have called this meeting, is....



THIS YEAR WILL MARK the 30th anniversary of the accident that took the life of Bill Compton and almost - Kathy Radina. I remember sitting uselessly and helplessly with Nina Joy in Kathy's hospital room. There was nothing to be said and Nina said it eloquently.

If I remember correctly, it was the day before the Summer Solstice. Sad but somehow appropriate for Little Willy Sunshine.

In 1996 a bunch of us got together at Papago Park in the steamiest, scorchiest part of the year. I have always wondered how it is that we don't FEEL that. Must be a dry heat. That winter back in Texas, I repeated the hospital scene of 1977 with my wife somehow surviving the wreck that killed our 12-yeqr-old daughter, Summer.

At the 1996 reunion I met Wonderful Russ on the bridge over the Papago Park lake that night. We immediately hit it off and began sharing jokes and diatribes that have spilled over annoyingly to hundreds of email exchanges that finally resulted in the birth of the KCAC Lives! blog where it has taken on an element of class and group participation that has become a rallying media.

I miss Russ. He doesn't BLOG much. The Man You Love To Hate. The consumate salesman.The guy that somehow, seems like a telemarketer without a phone. A beloved antithesis of really, all we despise about America. Some people really DO hate him - and they don't KNOW why. He is THAT GOOD with his act.

THEREFORE I am going to publicly suggest that a reunion be held once again, at Papago Park or South Mountain or Alwun or any location that will acomodate a few hundred people, in honor of Bill Compton as near to The Solstice as is practical. It happens that Bill's sister Carole (Compton) Glenn has a birthday right around that time as well.

Kids, hippies and naked people welcome. Leave your ID and shirts at the door and let's find each other.

I will make a final, superhuman effort to attend and bring my family if possible. If not possible, I will come without them.

NEW KCAC TAPES!

Thanks to collector Gary Pfeifer, I now have a brief tape (on CD) of Ron Wortham on the air at KCAC on New Years Eve 1969! It's short but sweet, most of the music is edited out (just fragments of Creedence and Led Zep), but there's about 8 minutes worth of talk and commercials. Ron mentions how cold it was that morning at his "house in the country" (Starbrite) and that his car was iced over and "Bill's car broke down." There are also commercials for Wallich's Music City and for a New Years Eve show that night with Waylon Jennings at JD's.

On the same disc is - get this - a brief recording of KCAC in 1963, when it was an R&B station! Only about 6 minutes long but it contains a mix of DJ chatter, commercials (including one for an upcoming show by James Brown), and music (one complete song by Jimmy Reed). The date is November 21, 1963, the day before a somewhat more ominous event.

The disc also contains a non-KCAC aircheck, again from December 31 1969, of Phoenix Top-40 station KRIZ. This aircheck runs 32 minutes and the DJ is Mark James. It seems to be intact and unedited - i.e., music, commercials, everything that aired during that 32 minutes. Music ranges from Zeppelin to "Gimme Shelter" to whatever else was in the Top 40 at that time.

Quality of the tapes is variable (and mostly pretty hissy) but they are all perfectly listenable. Don't ask me who recorded them, or why, or anything else - this information doesn't tend to travel much in the community of aircheck aficionados, where the recording itself is the object of interest, and it passes through many hands and much copying along the way. The important thing is that the tape has been added to the growing KCAC archives!!!

Who Knew Half a Who Could Still Howl

Went to see The Who last night at the arena. Phenomenal show .. amazing how well they can still do it. I just had a big grin on my face all nite. And since my son Coleman could not go with me (he's in Maryland) I went online today and ordered a DVD copy of last night's show! Thery actually record each show and make it available online at www.themusic.com. They called it a "legal bootleg"
We've come a long way. In the intro to Baba O'Reilly (teenage wasteland) Pete said, "Hey you Woodstock people ought to have it nailed down by NOW" Fun stuff.
